বান্দরবান লামায় সাম্প্রদায়িক হামলার আইনি প্রক্রিয়া নিয়ে বাংলাদেশ মাইনরিটি ওয়াচ হস্তক্ষেপ

বান্দরবন জেলার লামা থানার ঘটনা : গত ১৪।১০।২০২১ ইং তারিখে দিনের বেলায় ৯ ঘটিকার সময় কুমিল্লা পূজামণ্ডপে পবিত্র ধর্মগ্রন্থ আল-কোরআন অবমাননাকে কেন্দ্র করে লামা উপজেলা পরিষদের সম্মুখে মুসলিম জনতা বৃহস্পতিবার এক মানববন্ধন আয়োজন করে । বক্তব্য শেষে তৌহিদী জনতা ১০ টা ৩০ মিনিটের সময় উস্কানিমূলক বাক্য সহকারে কেন্দ্রীয় হরি মন্দিরের দিকে তাদের হাতে থাকা ইট ,পাথরের টুকরা, গাছের লাঠি, লোহার রড , হাতুড়ি , দা , গামা ইত্যাদি ধারালো মারাত্মক অস্র দিয়ে মন্দিরের গেট ভাঙ্গিয়া অবৈধ ভাবে প্রবেশ করে এক নম্বর আসামি মোঃ শাহিনের নির্দেশে মন্দিরে অবস্থানরত দেবনাথ দাস, নিউট্‌ন , তপন কান্তি চক্রবর্তী , বাসুদেব , সৌরভ সেন দাস ঝন্টু কর্মকার ও জয়দেব কে তাদের শরীরের বিভিন্ন স্থানে নিলাফুলা জখম করে এবং মন্দিরের বিভিন্ন সামগ্রী ৫০ লক্ষ টাকার ক্ষতিসাধন করে , হিন্দুদের দোকানে হামলা করে সর্বমোট ৭২ লক্ষ ৩৫ হাজার টাকা ক্ষতি সাধন করে । মামলার বাদী প্রশান্ত ভট্টাচার্য ৪৮ জন আসামির বিরুদ্ধে থানায় মামলা নম্বর ৫ এবং ৬ দায়ের করে ১৭।১০।২১ তারিখে । 

বাংলাদেশ মাইনরিটি ওয়াচ এর সভাপতি অ্যাডভোকেট রবীন্দ্র ঘোষ ভার- প্রাপ্ত কর্মকর্তার সঙ্গে যোগাযোগ করার পর দুইটি মামলায় আসামিদের বিরুদ্ধে অভিযোগের তিনি বলেন 17 জনের বিরুদ্ধে আসামিদের গ্রেপ্তার করে এবং অন্য জনকে ধরা একটা করে কিন্তু অত্যন্ত দুঃখের বিষয় হল এই আসামিরা গ্রেপ্তার হওয়ার পর জুডিশিয়াল ম্যাজিস্ট্রেট এর নিকট যখন তারা সারেন্ডার করে তখন লামা জুডিসিয়াল ম্যাজিস্ট্রেট তাদের সবাইকে জামিন প্রদান করে এলাকার লোকজন অত্যন্ত মনে কষ্ট পায় এবং বিক্ষুব্ধ সাহেবের প্রতি
বাংলাদেশ মাইনরিটি ওয়াচ উক্ত ঘটনার জন্য তীব্র নিন্দা করেছেন এবং আসামিদের পুনরায় গ্রেপ্তার করে আইনের আলোকে তাদেরকে সাজা প্রদানের জন্য সরকারের নিকট দাবী জানাচ্ছে ।

On 14.10.2021 at 9 o'clock in the day, a huge Muslim masses organized a human chain in front of the Lama Upazila Parishad of Bandarban District on Thursday at the incident of desecration of Al Quaran at Puja Mandap of Comilla to protest against the desecration of the holy book Al-Quran. At the end of the speech, at 10.30 am, the Touhidi crowd broke (with deadly weapon) the gate of the temple with sharp weapons like bricks, stones, tree sticks, iron rods, hammers, photos, gamma etc. in their hands. Devnath Das, Newton, Tapan Kanti Chakraborty, Basudev, Sourav Sen Das, Jhantu Karmakar and Joydev, who were staying at the temple under the direction of accused Mohammad Shaheen started breaking idols and houses of Hindus causing heavy loss to Hindus. The complainant of the case Prashant Bhattacharya filed case nos. 5 and 6 against 46 accused on 17.10.21 at Lama police station. But the O.C. Lama committed error to add section 295 of penal code which is quite illegal in the eye of law.
Advocate Rabindra Ghosh, president of Bangladesh Minority Watch, after contacting the officer-in-charge of Lama p.s. informed that the section 295 of penal code was omitted as a result the arrested accused in two cases got bail. He said that 17 accused were arrested but O.C. is not responsible for granting bail of accused.. When they surrendered, the Lama Judicial Magistrate Md.Anisur Rahman granted bail to all of them. BDMW started fact finding.
Bangladesh Minority Watch has strongly condemned the incident and also aggrieved at granting the bail of accused in custody & demanded the government to re-arrest the accused and punish them in the light of the law. The injured and traumatized victims should be provided with medical assistance. The Minorities should be protected and saved.
